1. Agreement to these terms

These terms of service form a binding agreement between you and My Gains Global ("MGG", "we", "us") and govern your access to and use of the MGG website, the authenticated dashboard and any related service. By creating an account, or by using the website, you confirm that you have read these terms and agree to them. If you do not agree, do not use the service.

Please read these terms alongside our privacy policy, our cookie policy and our risk disclosure, each of which forms part of this agreement.

2. Definitions

• Account means the MGG account registered in your name.
• Platform means the MGG website, the authenticated dashboard and any application or interface through which the service is made available.
• Order means an instruction you submit to buy or sell an asset, including any take profit or stop loss attached to it.
• Plan means a fixed-term investment product offered through the platform.
• Content means the text, data, charts, interfaces, software and other material made available through the platform.

3. Eligibility

To open and hold an account you must:

• be at least 18 years old, or the age of majority in your jurisdiction if that is higher;
• have the legal capacity to enter into this agreement;
• act on your own behalf and not for an undisclosed third party;
• not be resident in, or accessing the service from, a territory in which we do not offer it, and not be subject to applicable sanctions.

One account per person. We may decline an application, and we may close an account, where these conditions are not met.

4. Your account

• You must provide accurate, current and complete information, and keep it up to date.
• You are responsible for keeping your password, two-factor codes and recovery codes confidential.
• You are responsible for all activity carried out through your account.
• You must notify us without delay at [email protected] if you suspect unauthorised access.
• You may not transfer your account, or allow anyone else to use it.

5. Verification and compliance

We are required to verify the identity of our customers and to monitor activity for financial crime. You agree to provide the identity and source of funds information we request, and to provide updated information on request. We may delay, refuse or reverse a transaction, restrict account functionality, or suspend an account where verification is incomplete, where information appears inaccurate, or where we are required to do so by law.

6. Acceptable use

You agree not to:

• use the platform for an unlawful purpose, including money laundering, terrorist financing, sanctions evasion, tax evasion or fraud;
• attempt to gain unauthorised access to any part of the platform, another account, or any connected system;
• interfere with the operation of the platform, including by automated scraping, load generation or circumventing rate limits;
• engage in market abuse, including manipulative or deceptive trading practices;
• misrepresent your identity, or provide falsified verification documents;
• reverse engineer, copy or redistribute any part of the platform except as permitted by law.

7. Orders and instructions

When you submit an order or another instruction, you authorise us to act on it. An instruction cannot normally be recalled once it has been executed. We may refuse or cancel an instruction where it would breach these terms or applicable law, where your account has insufficient available balance, where the market is closed or disrupted, or where we reasonably suspect fraud or error.

Order types, including take profit and stop loss, operate as described on the trading page. A stop loss sets the level at which a position is closed; it does not guarantee the price obtained. See the risk disclosure for the full statement.

8. Deposits and withdrawals

Deposits and withdrawals may only be made through methods held in your own name. Processing times depend on the method and on any checks that apply. We may set minimum and maximum amounts, and may hold a withdrawal while verification or a security review is completed. You are responsible for the accuracy of the payment or wallet details you provide; a transfer sent to details you have entered incorrectly may not be recoverable.

9. Fees and charges

Fees applicable to an order, a transfer or a plan are shown before you confirm it and are recorded in your transaction history afterwards. Network fees charged by a third-party payment or blockchain network are separate from our own fees. We will give reasonable advance notice of a change to a fee schedule.

10. Market data and content

Market data, charts, figures and other content are provided for information only. They may be delayed, indicative or incomplete, and they are not an offer to transact at any price shown. We do not warrant that content is accurate, complete or current, and we are not liable for a decision made in reliance on it.

11. Risk and no advice

Trading and investing carry risk, including the loss of capital. Nothing on the platform is financial, investment, tax or legal advice, or a recommendation to buy or sell anything, and no outcome is promised or guaranteed. A plan's stated return describes how the product is structured, not what you will earn. You are responsible for deciding whether a product is suitable for you. Our risk disclosure forms part of these terms.

12. Availability

We aim to keep the platform available but do not guarantee uninterrupted or error-free access. Maintenance, upgrades, third-party failures and events outside our reasonable control can interrupt the service. We may modify, suspend or discontinue any feature, and will give notice where it is reasonable to do so.

13. Intellectual property

The My Gains Global name, the MGG mark, the logo, the interface design, the software and the content are owned by My Gains Global or its licensors and are protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform for your own personal account. No other right is granted.

14. Privacy

Personal information is handled as described in our privacy policy. Browser storage and cookies are covered by our cookie policy.

15. Suspension and termination

We may suspend or close an account where these terms are breached, where verification cannot be completed, where we reasonably suspect fraud or unauthorised access, or where we are required to do so by law. Where we can lawfully do so, we will tell you the reason.

You may close your account at any time once open positions are closed, plans have matured or been exited under their terms, and any remaining balance has been withdrawn. Sections that by their nature should survive termination, including sections 13, 16, 17 and 19, continue to apply.

16. Limitation of liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.

Subject to that, and to the maximum extent permitted by law, we are not liable for trading or investment losses, lost profits, lost opportunity, loss of data, or any indirect or consequential loss arising out of or in connection with your use of the platform. Our total liability in connection with this agreement is limited to the total fees you paid to us in the twelve months before the event giving rise to the claim. The platform and its content are provided on an "as is" and "as available" basis, and all warranties not expressly stated here are excluded to the extent permitted by law.

17. Indemnity

You agree to indemnify us against any loss, liability, claim or reasonable expense we incur arising out of your breach of these terms, your misuse of the platform, or your breach of applicable law.

18. Complaints

If something goes wrong, write to [email protected] with your account details and a description of the issue. We will acknowledge your complaint, investigate it and give you a written outcome. Raising a complaint does not affect your other rights.

19. Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of the State of Oklahoma and the applicable federal laws of the United States, without regard to conflict of law principles. The courts located in Tulsa County, Oklahoma have jurisdiction, except where the law of your country of residence gives you the right to bring proceedings elsewhere. Before commencing proceedings, both parties agree to attempt in good faith to resolve the dispute through the complaints process above.

20. General

• Entire agreement. These terms, together with the documents referred to in them, form the entire agreement between us on this subject.
• Severability. If a provision is found unenforceable, the rest continues in force.
• No waiver. A delay in enforcing a right is not a waiver of it.
• Assignment. You may not assign this agreement. We may assign it to a group company or in connection with a reorganisation, without reducing your rights.
• Force majeure. Neither party is liable for a failure caused by an event outside its reasonable control.
• Notices. We may contact you using the email address registered to your account. You may contact us at the address below.
• Language. These terms are written in English, and the English version prevails.

21. Changes to these terms

We may update these terms, for example to reflect a change in the service or in the law. We will give reasonable advance notice of a material change by email or through the platform, and the date at the top of this page records the latest revision. Continuing to use the service after a change takes effect means you accept the updated terms; if you do not, you may close your account.
